PRELIMINARY INJUNCTION. IT IS HEREBY ORDERED: 1. The parties shall promptly contact the Chambers of the Honorable Becky Thorson at (651) 848-1210 to schedule a hearing to address any details regarding the performance of the Preliminary Injunction, including whether additional parameters should govern the contact between Father and the children; to set a scheduling order for the filing and exchange of witness lists, exhibit lists, exhibits, motions in limine, responses to motions in limine, trial briefs, and any other pretrial documents before the October 27, 2021 bench trial; and to discuss the possibility of a negotiated settlement to this matter. 2. Respondent is ordered to file her Answer to the Petition by October 1, 2021 at 4:30 p.m. 3. A bench trial on this case is set for Wednesday, October 27, 2021 at 9:00 a.m. in Courtroom 13E of the United States District Court for the District of Minnesota, located at 300 South Fourth Street, Minneapolis, Minnesota 55415. 4. Petitioner Jonatan Rosas Sanchez's oral motion for a preliminary injunction is GRANTED as follows: a. Respondent Erika Sanchez Pliego shall immediately surrender all of EJRS's and KJRS's valid and expired passports and any other travel documents, if they exist, to the Court, and shall not seek to have any travel documents or passports issued for the children without further order of the Court or Fathers agreement. b. Respondent is prohibited from removing or facilitating the removal of the children, EJRS and KJRS, from the jurisdiction of this Court. c. Mother is ordered to facilitate contact between the children and Father at least three times per week by telephone or video conference. Mother and Father are ordered that conversations with the children shall be respectful; shall not disparage the other parent; and shall not discuss this proceeding. d. Mother shall promptly provide to Father information regarding the schools that children are attending and have attended during the past 18 months; the children's medical conditions currently and during the past 18 months; and the medical care that children have received during the past 18 months and are currently receiving. e. TEMPORARY RESTRAINING ORDER. IT IS HEREBY ORDERED: Petitioner Jonatan Rosas Sanchez's Ex Parte Motion for Accelerated Hearing and Request for Temporary Restraining Order 6 is GRANTED as follows: 1. Respondent Erika Sanchez Pliego shall immediately surrender all of EJRS's and KJRS's valid and expired passports to the process server personally serving Respondent with this Order. 2. The process server shall immediately return all passports collected to the District of Minnesota Clerk of Court for collection and safekeeping. 3. Respondent is prohibited from removing or facilitating the removal of the children, EJRS and KJRS, from the jurisdiction of this Court. 4. Respondent shall appear with EJRS and KJRS before this Court on September 24, 2021, at 11:00 a.m. in Courtroom 13E of the United States District Court for the District of Minnesota, located at 300 South Fourth Street, Minneapolis, Minnesota 55415. The initial appearance shall be considered an initial Show Cause Hearing for Mother to show cause why she should not be held in contempt of Court for failing to appear at the September 3, 2021 hearing with her children and a scheduling hearing, so that the Respondent can confirm to the Court that the minor children are physically located within the jurisdiction of this Court, and so that a date may be set for an expedited evidentiary hearing on the merits of the Petition for Return. 5. If the Respondent either fails to appear on September 24, 2021, at 11:00 a.m. with the minor children, or removes the minor children or causes the minor children to be removed from the jurisdiction of this Court, the Court shall issue a warrant for the arrest of the Respondent and appearance for a contempt hearing. 6. Petitioner shall immediately serve a copy of this Order and a copy of the verified Petition and accompanying exhibits upon Respondent. 7. Petitioner is permitted to appear at the September 24, 2021 hearing by telephone or video conference. 8.
