April 20, 2022 Opinion or Order Filing 14 (Text-Only) ORDER/NOTICE TO ATTORNEY. This matter is before the Court on Petitioners Thomas Lynch and Rosemary Nelson's #1 Motion to Compel Respondent Trans Union LLC's Compliance with a Subpoena. To bring this newly-transferred Motion into compliance with this District's Local Rule 7.1(b), Petitioners shall file a supplemental meet-and-confer statement that fully complies with Local Rule 7.1(a)'s requirement that the movant engage "in a good-faith effort to resolve the issue raised by the motion[,]" and with this Court's practice pointers which state that "[n]either a desultory, pro forma conversation, nor letter-writing or email campaigns satisfy the letter - or the spirit - of the meet-and-confer requirement of the Local Rules." Therefore, Petitioners shall engage in additional meet-and-confers with Respondent as needed to bring such conferrals in line with these requirements. Petitioners and Respondent shall specifically meet-and-confer on, and include in the statement that Petitioners provide to the Court, whether the subpoena for documents, including the Dominium Account information, would be mooted if Petitioners give Respondent permission to release account information to Petitioners about when Respondent knew the Dominium Account had been discharged in bankruptcy. Petitioners shall file their meet-and-confer statement on or before 5/20/2022. The Court will decide this Motion to Compel on the papers, without a hearing, and has taken Petitioners' Motion to Compel under advisement. Ordered by Magistrate Judge John F. Docherty on 4/20/2022.
