(Text-Only) ORDER: Defendant filed a Rule 12(b)(6) motion to dismiss on September 5, 2023. ECF No. 4. That motion is scheduled to be heard on October 30, ECF No. 5. After Defendant filed its motion, Plaintiff filed a motion seeking leave to file an amended complaint that would "add[] another count alleging bad faith as allowed under the provisions of Minnesota Statute 609.18, subdivision 4." ECF No. 14. Plaintiff's motion is scheduled to be heard by Magistrate Judge Leung on October 17. ECF No. 18. Given the case's procedural posture, it makes better practical sense to postpone Defendant's reply-brief deadline, and the hearing on Defendant's motion, to dates after Magistrate Judge Leung decides Plaintiff's motion. If Judge Leung grants Plaintiff's motion, Defendant will have to decide whether and to what extent it wishes to seek dismissal of the amended complaint. If Judge Leung denies Plaintiff's motion, an order will be entered establishing a new deadline by which Defendant must file its reply brief in support of its motion and a new hearing date.
