Filing 6 OPINION, MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiff's motion to proceed in forma pauperis is GRANTED. [ECF No. 2] IT IS FURTHER ORDERED that plaintiff must pay an initial filing fee of $1.00 within twenty-one (21) days of the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court", and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittanc e is for an original proceeding. IT IS FURTHER ORDERED that plaintiff's claims against defendants City of Cape Girardeau, Missouri and County of Cape Girardeau, Missouri are DISMISSED without prejudice. IT IS FURTHER ORDERED that plaintiff' s claims for excessive force and civil conspiracy are DISMISSED without prejudice. IT IS FURTHER ORDERED that plaintiff's motion for appointment of counsel is DENIED as moot. [ECF No. 4]IT IS FURTHER ORDERED that plaintiff's motion for pre liminary injunction is DENIED. [ECF No. 5]. IT IS FURTHER ORDERED that all proceedings in this case are STAYED pending final disposition of the criminal charges pending against plaintiff in State v. Wilson, No. 16CG-CR02278-01 (32nd Judicial Circuit, Cape Girardeau County), as well as any direct appeals and post-conviction proceedings. IT IS FURTHER ORDERED that plaintiff shall notify the Court in writing concerning the final disposition of the criminal charges pending against him in State v. Wi lson, No. 16CG-CR02278-01 (32nd Judicial Circuit, Cape Girardeau County), as well as any direct appeals and post-conviction proceedings. IT IS FURTHER ORDERED that this case is ADMINISTRATIVELY CLOSED pending final disposition of the criminal charges against plaintiff, and may be reopened by plaintiff's filing of a motion to reopen the case after such final disposition of all direct appeals and post-conviction proceedings.A separate order of partial dismissal will accompany this opinion, memorandum and order.
