[Doc. 332] IT IS FURTHER ORDERED that the motion of defendants Premier Election Solutions, Inc.; Sequoia Voting Systems; and Election Systems & Software, Inc., for summary judgment that claims 26-28, 30, and 49-51 of U.S. Patent No. 6,892,944 are invalid for lack of a written description under 35 U.S.C. Section 112, Paragraph 1 is GRANTED. [Doc. 335] Each of these motions concern equipment that was first the subject of Avante's proposed fourth amended complaint. Avante was not granted leave to file this complaint. IT IS FURTHER ORDERED that the motion of Avante International Technology Corporation for summary judgment that U.S. Patent Nos. 6,892,944 and 7,077,313 are not invalid in view of Defendants' references and 15 U.S.C. Section 112 arguments is DENIED.
