February 18, 2010 Opinion or Order Filing 82 MEMORANDUM AND ORDER. ORDERED that Metropolitan Towing's motion to dismiss the claims of Plaintiff Earl Johnson [Doc. 19 ] is GRANTED in part so as to dismiss Plaintiff Johnson's conversion claim in Count II and Plaintiff Johnson's ne gligence claim in Count III. FURTHER ORDERED that Metropolitan Towing's motion to dismiss the claims of Plaintiff Earl Johnson [Doc. 19] is otherwise DENIED. FURTHER ORDERED that Metropolitan Towing's motion to dismiss Count I [Doc. 17 ] is GRANTED in part so as to dismiss the alleged losses based on the deprivation of the value of the vehicle, the delay in "any recovery" due Plaintiffs under the insurance policy, and Plaintiffs' "loss of time, effort and earnings capacity, humiliation and emotional distress." FURTHER ORDERED that Metropolitan Towing's motion to dismiss Count I [Doc. 17] is otherwise DENIED. FURTHER ORDERED that Metropolitan Towing's motion to dismiss Plaintiffs' claims fo r infliction of emotional distress [Doc. 47 ] is GRANTED in part to dismiss the humiliation and emotional distress allegations from the Merchandising Practices Act claim in Count I and the negligence claim in Count III. FURTHER ORDERED that Metropol itan Towing's motion to dismiss Plaintiffs' claims for infliction of emotional distress [Doc. 47] is otherwise DENIED. FURTHER ORDERED that City's motion to dismiss [Doc. 43 ] is GRANTED with respect to Plaintiffs' § 1983 cl aimin Count Vbased on an alleged failure properly to train, monitor, or supervise St. Louis police officers, on a "widespread or pervasive custom of the St. Louis Metropolitan Police Department to conspire with "Metropolitan Towing to misus e police authority; and on "[p]olicymakers with final authority on police department policymaking an official decision (or decisions) or otherwise authorizing the practice of conspiring with" Metropolitan Towing.
