MEMORANDUM AND ORDER...IT IS HEREBY ORDERED that Defendants' motions for summary judgment are DENIED in part, with respect to Plaintiffs breach of contract claims (Counts I and II) only to the extent such claims arise out of the assertion of a medical lien, as set forth above; the motions are otherwise GRANTED. IT IS FURTHER ORDERED that, within seven (7) days of the date of this Memorandum and Order, the parties shall file a joint notice advising the Court whether any part of their motions to exclude expert testimony (ECF Nos. 70 & 76 ) relates to the claims remaining in this case, and if so, which part(s). Failure to comply with this Order will result in the denial of these motions as moot.
