MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that Plaintiff's motion seeking leave to commence this action without prepaying fees or costs (ECF No. #9 ) is GRANTED. IT IS FURTHER ORDERED that, within thirty (30) days of the date of this order, Plaintiff must pay an initial partial filing fee of $1.00. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) the statement that the remittance is for an original proceeding. MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Clerk shall mail to Plaintiff a copy of this order and a copy of the Court's form Prisoner Civil Rights Complaint Under 42 U.S.C. 1983. IT IS FURTHER ORDERED that the Clerk shall mail to Plaintiff a copy of the Court's form Application to Proceed in District Court Without Prepaying Fees or Costs. IT IS FURTHER ORDERED that, within thirty (30) days of the date of this Order, Plaintiff shall file a signed amended complaint in accordance with the foregoing instructions. IT IS FURTHER ORDERED that, within thirty (30) days of the date of this Order, Plaintiff shall either pay the $405 filing fee, or file an Application to Proceed in District Court Without Prepaying Fees or Costs along with a certified copy of his inmate account statement for the six-month period preceding the filing of the complaint. | Filing 2 MEMORANDUM AND ORDER [COPY OF ORDER ENTERED IN CASE 4:23-CV-01071-SRC]: For these reasons, the Court directs the Clerk of Court to strike plaintiffs Kelly McSean and Dakota Pace from this action, and to alter the case caption for this case accordingly. The Court also directs the Clerk to open a new case for each McSean and Pace, using the same complaint filed in this case. Finally, the Court directs the Clerk to file a copy of this memorandum and order in each of the two new cases.
