ORDER granting in part and denying in part Motion to Dismiss for Failure to State a Claim (Doc. 12 ). Count I is dismissed with prejudice as against Kevin Short and Natalie Short. Counts II and III are dismissed without prejudice as to Natalie Short, and dismissed without prejudice as to KNS and Kevin Short insofar as they relate to the construction contract or promises made by the Shorts to repay the Myers for damages.
