An appeal may not be taken in forma pauperis if it would be frivolous and therefore could not be taken in good faith. Franklin v. Dormire, No. 04-0335, 2009 WL 962285, at *1 (E.D. Mo. Apr. 7, 2009) (citing Coppedge v. United States, 369 U.S. 438, 44445 (1962)); see also 28 U.S.C. 1915(a)(3); Federal Rule of Appellate Procedure 24(a). Because the Court has found that Plaintiff's claims are frivolous (see Doc. #3 ), the Court denies the motion for leave to proceed on appeal in forma pauperis.
