Filing 11 ORDER by Judge Nanette K. Laughrey. Based on the face of the proposed complaint, the court lacks personal jurisdiction against most defendants and venue appears improper because all defendants but one are based in California and the alleged conduct did not take place in Missouri. The additional claims and defendants that the plaintiff seeks to add through her motions would not cure the deficiencies. As for the sole defendant that is alleged to live in Missouri, the complaint does not suggest what, if any, role she played in connection with Plaintiff's claims and allegations. Plaintiff therefore has failed to state a claim against that Missouri defendant, Tatianna Cruz. Accordingly, the motion to proceed in forma pauperis (Doc. #1 ) is granted, but the case against Tatianna Cruz is dismissed for failure to state a claim, and the case against the remaining defendants is dismissed for lack of personal jurisdiction and improper venue. See Sanders v. United States, 760 F.2d 869, 871 (8th Cir. 1985) (affirming dismissal of pro se complaint as frivolous where, "[a]fter a close reading of the plaintiff's detailed complaint, it is clear that he can allege no set of facts which would support an exercise of jurisdiction over the defendants by the district court" because "[t]he plaintiff's complaint fails to allege that the [out-of-state] defendants committed any act in Missouri"); Lietzke v. City of Montgomery, No. CV 16-5111-JLV, 2017 WL 58829, at *2 (D.S.D. Jan. 5, 2017) (granting motion for leave to proceed in forma pauperis and dismissing complaint for want of personal jurisdiction over defendants (citing Sanders, 760 F.2d at 871)); Fed. R. Civ. P. 12(b)(6). The motions to add additional claims for relief and additional California-based defendants (Docs. #6 , #7 , #8 , #9 , and #10 ) are DENIED on the ground that any such amendments would be futile.
