ORDER: ORDERED that: (1) the agency having custody of Plaintiff forward to the Clerk of the Court monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account each time the amount in the account exceeds $10.00 until the $350.00 filing fee is paid; (2) Defendant Caldwell County Jail is dismissed as a party in this case; (3) the Clerk of the Court send the parties the mediation request form mentioned herein; (4) the Clerk of the Court issue appropriate summons as authorized by Federal Rule of Civil Procedure 4, and deliver the summons, the complaint, and a copy of this order to the United States Marshal for service of process; (5) the United States Marshal attempt personal service of process, at no cost to Plaintiff, on Defendants Silkwood and Jordan; (6) Defendants Silkwood and Jordan answer or otherwise respond to Plaintiff's complaint within 21 days from the date of service as required by Federal Rule of Civil Procedure 12; and (7) Plaintiff's motion for appointed counsel (Doc. #5 ) is denied at this time without prejudice, see Phillips v. Jasper County Jail, 437 F.3d 791, 794 (8th Cir. 2006) (no right to counsel in civil cases; criteria for appointment), and Plaintiff is free to renew his motion for appointed counsel as the case progresses.Signed on 10/13/2021 by District Judge Stephen R.
