American Dairy Queen Corporation v. McMurray et al
Plaintiff American Dairy Queen sues defendant Dairy Queen franchisees for alleged trademark infringement, alleging that defendants breached their franchise agreement by failing to remediate filthy and unsanitary conditions at their store.
According to plaintiff:
The goodwill and reputation associated with DAIRY QUEEN® are impaired when any DAIRY QUEEN® franchisee fails to maintain ADQ's minimum standards of health, sanitation and safety and operates on unsanitary or unsafe business under the DAIRY QUEEN® marks.
