ORDER denying 11 plaintiff's motion for summary judgment and granting in part and denying in part 5 defendant's motion to dismiss. The Court GRANTS defendant's motion for more definite statement. Plaintiff shall file an amended co mplaint on or before NOVEMBER 12, 2015.
