August 25, 2026 Opinion or Order Filing 14 ORDER: Plaintiff's recent motion to the Court, wherein Plaintiff asks for this case to be reopened, the initial partial filing fee to be waived, and to be appointed counsel (Doc. #13 ) is denied. This case was dismissed on August 17, 2026, after Plaintiff failed to pay the $16.23 initial partial filing fee and then failed to respond to this Court's order directing him to show cause for his failure to do so. Doc. #11 . Although Plaintiff argues that he is indigent, he has had sufficient funds deposited into his inmate account with which he could have paid the initial partial filing fee. Notably, the inmate account statement submitted in another case filed by Plaintiff, Case No. 2:26-cv-04185-BP, shows that a deposit of $75.00 was made into Plaintiff's account on July 24, 2026, and that Plaintiff then made a canteen purchase of $57.58, with a remaining balance of $17.54. Plaintiff also appears to continue to receive monthly payroll deposits in the amount of $10.00. Therefore, Plaintiff fails to establish that he is unable to pay the initial partial filing fee, which was calculated based on the regular deposits into Plaintiff's inmate account. Plaintiff's renewed request for appointment of counsel is denied for the same reasons set forth in this Court's prior order denying such relief (Doc. #6 ) and because Plaintiff has not complied with this Court's orders.
