Filing 64 ORDER granting in part and denying in part 38 Motion to Dismiss for Failure to State a Claim; granting in part and denying in part 50 Motion to Dismiss for Failure to State a Claim. All of Plaintiff's claims against Defendants Robert Schum ann and Tom Hyberger are dismissed without prejudice. All of Defendants claims against Defendants Regional Recovery Services, Inc. and Jim Axford are dismissed without prejudice, with the exception of Plaintiff's claim pursuant to 15 U.S.C. Sec . 1681b(f) for violation of the Fair Credit Reporting Act, which may proceed. The Court further finds as moot 40 motion for more definite statement; finding as moot 41 motion to dismiss for lack of jurisdiction and insufficient service of proc ess. The Court further hereby GRANTS Defendants' motion to Strike (Docs. 57 and 58). Plaintiff's More Definite Statement of claim is hereby Stricken (Doc. 55). The Court hereby denies Plaintiff's requests for imposition of sanctions against Defendants and Defendants' counsel. Motion for Discovery [Doc. 63] is terminated.
