ORDER that Plaintiff's Motion for Emergency Hearing and to Expedite Injunction (Doc. #8 ) is denied. This case will proceed according to the schedule set by the Court. Plaintiff fails otherwise to establish that a preliminary injunction should issue. See Dataphase Systems, Inc. v. C.L. Systems, Inc., 640 F. 2d 109, 113 (8th Cir. 1981) (listing the factors considered by the district court in determining if a preliminary injunction should be issued). Insofar as Plaintiff intended his motion to request appointment of counsel, that request is denied without prejudice, as the record has not been developed sufficiently to determine if appointment of counsel is justified. See Phillips v. Jasper County Jail, 437 F.3d 791, 794 (8th Cir. 2006) (listing the factors to be considered by the district court in determining whether to appoint counsel in a civil case).
