Filing 5 ORDERED that: (1) the agency having custody of Plaintiff shall forward to the Clerk of the Court monthly payments of 20 percent of the preceding month's income credited to Plaintiff's account each time the amount in the account exceeds $10.00 until the balance of the $350.00 filing fee is paid ($287.94); (2) except for Plaintiff's Fourth Amendment claim against Defendant Nicholson related to the August 2021 stop, each of Plaintiff's claims are dismissed pursuant to 28 U.S.C. 1915A(b)(1); (3) Defendants Springfield Police Department and Friend are severed and dismissed from this case for the reasons set forth herein;(4) the Clerk of the Court shall issue appropriate summons as authorized by Fed. R. Civ. P. 4, and shall deliver the summons, the complaint, a mediation request form, and a copy of this Order to the United States Marshal for service of process on Defendant Nicholson (at the following address: 321 E. Chestnut Expressway, Springfield, MO 65802);(5) the United States Marshal shall attempt service of process of the summons, the complaint, a mediation request form, and a copy of this Order upon Defendant Nicholson as directed by Fed. R. Civ. P.4 (at the address referenced above); and(6) Defendant Nicholson shall answer or otherwise respond to Plaintiffs complaint within twenty-one days from the date of service as required by Fed.
