January 2, 2026 Opinion or Order Filing 25 ORDER: Plaintiff's Motion for Appointment of Counsel (Doc. #23 ) is DENIED without prejudice because it does not appear, at this time, Plaintiff's claims are factually or legally complex or that Plaintiff is unable to litigate his claims on his own. Plaintiff is advised that "[t]here is no constitutional right to appointed counsel in civil cases." Phillips v. Jasper County Jail, 437 F.3d 791, 794 (8th Cir. 2006) (citing Edington v. Missouri Dept of Corr., 52 F.3d 777, 780 (8th Cir. 1995)). Rather, "[i]n civil rights matters the court may, pursuant to 28 U.S.C. 1915, 'request' an attorney to represent a party if, within the court's discretion, the circumstances are such that would properly justify such a request." Mosby v. Mabry, 697 F.2d 213, 214 (8th Cir. 1982). When making this determination the Court should consider the legal complexity of the case, the factual complexity of the case, and the [plaintiff's] ability to investigate and present his claims, along with any other relevant factors. Hoggard v. Purkett, 29 F.3d 469, 471 (8th Cir. 1994). If Plaintiff requires an extension to meet of any of the deadlines set forth in the scheduling order he may file a motion seeking an extension that sets forth the reasons the extension is necessary.
