December 21, 2012 Opinion or Order Filing 221 JUDGMENT - IT IS ORDERED that: Except as provided in the following paragraphs, judgment is entered for the defendants and against the plaintiffs providing that plaintiffs shall take nothing and these matters are dismissed with prejudice. Doe 24s "as-applied" challenge to Neb. Rev. Stat. 29-4006(2) under the Fourth Amendment and the equivalent Nebraska constitutional provision is not ripe and is therefore dismissed for lack of Article III jurisdiction. The claims of the plaintiffs who are not required to register as sex offenders as those claims pertain to Neb. Rev. Stat. 29-4006(1)(k) and (s), 29-4006(2), and 28-322.05 (West, Operative Jan. 1, 2010) are dismissed without prejudice because they are moot. The defendants and their agents, servants, employees, attorneys and any other persons acting in concert with them are permanently enjoined from enforcing the foregoing statutes. The plaintiffs are hereby awarded attorneys' fees against the defendants in the amount of $292,564.88. Pursuant to Federal Rule of Civil Procedure 54(d)(1), the plaintiffs are prevailing parties for purposes of taxation of costs. If the plaintiffs desire to recover costs, they must file the required documents with the Clerk within 14 days.
