Filing 55 MEMORANDUM AND ORDER - Plaintiff is sanctioned for violating Rule 11 and ordered to pay the McClurgs $2,439.90 for their reasonable attorney's fees in defending this action. Plaintiff's Motion for Bill of Exceptions (filing no. 51 ) is denied. The Clerk of the court will transmit the record on appeal in accordance with all relevant rules and procedures. The Clerk of the court shall provide the Court of Appeals a copy of this Memorandum and Order. A separate judgment will be entered in accordance with this Memorandum and Order and the court's March 7, 2011, Memorandum and Order. Ordered by Chief Judge Joseph F. Bataillon. Filing 47 MEMORANDUM AND ORDER - The NADC Defendants' Motion to Dismiss (filing no. 10 ) and the McClurgs' Motion to Dismiss (filing no. 22 ) are granted. Plaintiff's Motion in Opposition (filing no. 45 ) is denied as untimely and without m erit. Plaintiff's Motion for Temporary Restraining Order (filing no. 12 ) is denied as moot. The McClurgs' Motion for Attorney's Fees (filing no. 24 ) is granted with respect to liability. The McClurgs shall have until March 28, 20 11, to file an affidavit detailing the attorney's fees they have incurred in defending this action. After the McClurgs file the affidavit, Plaintiff shall have 14 days to respond. If Plaintiff chooses to file a response, the McClurgs shall have 7 days to reply. The Clerk of the court is directed to set a pro se case management deadline with the following text: March 28, 2011: check for affidavit. Plaintiff's Complaint is dismissed with prejudice.
