MEMORANDUM AND ORDER- Filing 109 , Plaintiffs' Rule 56(d) motion to deny as premature, or in the alternative, continue Defendants' motion for summary judgment, is denied in all respects. Filing 98 , Defendants' motion for summary judgment of invalidity and non-infringement of U.S. Patent No. 5,811,009, is granted in part and denied in part, as follows: a. The motion is granted to the limited extent that the court hereby dismisses Plaintiffs claims with prejudice and declares that the Theresa Street Wastewater Treatment Facility does not infringe elements (b) and (d) of Claim 18 of the 009 Patent. b. Jeffries, Mary Ann Novak and Michelle L. Sitorius, as counsel of re cord for Plaintiffs Mixing & Mass Transfer Technologies, LLC and Peter Kos (filing no. 82 ), is granted.2) On or before January 28, 2013, Plaintiff Peter Kos shall either: (a) obtain the services of counsel and have that attorney file an appearance in this case; or (b) file a statement notifying the court of his intent to litigate this case without the assistance of counsel.
