The plaintiffs' 42 U.S.C. § 1983 claims are dismissed with prejudice as to the State and dismissed without prejudice as to all other defendants. The dispositive motions are denied in all other respects. The parties will bear their own attorney fees, costs, and expenses. This case is remanded to the District Court for Adams County, Nebraska. The plaintiffs' 42 U.S.C. § 1983 claims are dismissed with prejudice as to the State and dismissed without prejudice as to all other defendants. The dispositive motions are denied in all other respects. The parties will bear their own attorney fees, costs, and expenses. This case is remanded to the District Court for Adams County, Nebraska.
