ORDER AND CERTIFIED QUESTION - The preceding question is certified to the Nebraska Supreme Court pursuant to § 24-219. The Clerk of the Court shall forward a copy of this order to the Nebraska Supreme Court under the Court's official sea l, along with seven additional certified copies of this order and a certified copy of the Court's docket sheet. The parties shall pay the $126 in appellate filing fees forthwith, evenly divided between them, to the Clerk of the Nebraska Supreme Court and Court of Appeals. ORDER - that the School District may not redact or withhold information pertaining to: (a) individuals on the golf team(s) coached by Michael Klein from 2003 to the present, including their parents or guardians;(b) individuals who made or received a report or complaint about Klein, raised a concern about Klein, or otherwise made or received a statement in regard to Klein's behavior; (c) any victims of sexual harassment or abuse, or alleged sexual harassment or abuse, whether by Klein or other employees of the School District. The scope of this order extends to the School District's production of documents, its responses to written discovery, and in any depositions or other forms of testimony sought by Plaintiff. ORDER that the Plaintiff will prepare a proposed order regarding the FERPA issues as discussed at the telephone conference. Plaintiff shall confer with Defendant in preparing this order. The proposed order shall be submitted to the Court via ema il at bazis@ned.uscourts.gov. Defendant shall answer interrogatories and produce documents which relate to S.P., as well as other complaints, reports or investigations involving Defendant Michael Klein ("Klein") from January 1, 2003 to the present date. The definition of "School District" as used in Plaintiff's discovery requests is limited to the high school in which Klein worked, including that high school's governing body/school board. Defendant shall an swer the interrogatories and document production requests which have previously been put forward by Plaintiff in accordance with the provisions of this Order and the discussion during the telephone conference. Defendant shall supplement its respon ses to these discovery requests by August 24, 2018. In the event Plaintiff wants to serve additional interrogatories, she shall file a written motion with the Court, explaining why additional interrogatories are necessary.
