ORDER - Plaintiff has waived all objections to Defendants' written discovery. Plaintiff's full and complete responses shall be served on or before November 4, 2020. Over Defendants' objection, the court will permit a 30(b)(6)depos ition of Defendant Music Spoke, such deposition to be completed on or before November 13, 2020. Counsel shall immediately confer regarding the deposition topics for the 30(b)(6)deposition. If there are areas of dispute, a succinct summary of those issues shall be emailed to zwart@ned.uscourts.gov by no later than October 30, 2020 at 3:00 p.m., and they will be discussed and ruled on, on the record, during a telephonic hearing to be held on November 2, 2020 at 11:00 a.m. Couns el shall use the conferencing information assigned to this case to participate in the call. This conference call will be cancelled if no summary of disputed issues is received by 3:00 p.m. on October 30, 2020. The clerk shall set an internal case management deadline of December 14, 2020. ORDER - IT IS ORDERED that the Stipulation and Motion to Extend Expert Disclosure Deadline (Filing No. 83 ) is granted and the final progression order is amended as follows: The deadline for identifying expert witnesses expected to testify at the trial, (both retained experts, (Fed. R. Civ. P. 26(a) (2)(B)), and non-retained experts, (Fed. R. Civ. P. 26(a)(2)(C)), is now September 23, 2019. The deadline for complete expert disclosures for all experts expected to testify at trial, (bot h retained experts, (Fed. R. Civ. P. 26(a)(2)(B)), and non-retained experts, (Fed. R. Civ. P. 26(a)(2)(C)), is now October 21, 2019. The deadline for filing motions to exclude testimony on Daubert and related grounds is now November 22, 2019. The remaining unexpired deadlines set in the final progression order are unchanged. All requests for changes of deadlines or settings established herein shall be directed to the undersigned magistrate judge, including all requests for changes of trial dates. Such requests will not be considered absent a showing of due diligence in the timely progression of this case and the recent development of circumstances, unanticipated prior to the filing of the motion, which require that additional time be allowed.
