February 10, 2010 Opinion or Order Filing 138 MEMORANDUM AND ORDER denying 88 Defendant's Motion for Summary Judgment. Accordingly, the defendant's motion for summary judgment, insofar as it asserts that the Worth Street Textile Market Rules supply terms in the parties'contract regarding warranties-including that the seller warrants only that its merchandise will conform with the description on the face of the contract; that performance and other physical or chemical characteristics of the merchandise are not guaranteed; a nd that the seller makes no warranty in fact or law that the merchandise is suitable for any particular purposeis denied. There is insufficient evidence before me upon which to conclude that these damage-related provisions of the Worth Street Textile Market Rules were incorporated into the parties' contract as a "usage of trade" within the meaning of the Nebraska U.C.C. Therefore, this aspect of R-Five's motion for summary judgment shall be denied as well. Ordered by Judge Richard G. Kopf. (JAB)

January 14, 2009 Opinion or Order Filing 39 MEMORANDUM AND ORDER granting in part and denying in part 33 Plaintiff's Motion to Compel as follows: 1. To the extent the motion to compel seeks an order requiring the defendant to respond to plaintiff's discovery requests served on Octob er 6, 2008, the motion is denied as moot. 2. To the extent the motion to compel seeks an award of plaintiff's attorneys fees and costs expended in filing the motion to compel, the motion is granted, and a. Within 10 days of the date of this ord er, counsel for the plaintiff shall provide to defense counsel an itemized statement of the fees and expenses related to bringing this motion. b. The parties shall attempt in good faith to reach an agreement regarding the amount to be awarded by the court under Rule 37(a). If an agreement is reached, a joint stipulation shall be filed with the court setting forth the terms of that agreement. If no agreement can be reached, counsel for the plaintiff shall submit plaintiff's application for f ees to this court within 15 days of this order for the courts resolution of this issue. Any response by the defendant shall be filed within 15 days thereafter. No reply shall be filed absent leave of the court for good cause shown. In the event eithe r side desires a hearing on this question, request shall be made in the application or response, as applicable. c. The clerk shall make any award of attorneys fees and expenses herein a part of any judgment eventually entered in this case unless the parties file a statement with the clerk advising that the award of fees and expenses was paid prior to judgment, together with documentation of such payment.
