MEMORANDUM AND ORDER - 1. Defendant's Objections to Plaintiff's Evidence Submitted in Opposition to Motion for Summary Judgment (Filing No. 38 ) are sustained. 2. Defendant's Motion for Summary Judgment (Filing No. 28 ) is denied as to dismissal of Plaintiff's causes of action and Plaintiff's claim for back pay from the date of Tomlinson's termination, May 16, 2006, until the earlier of when Tomlinson stopped his job search or the date of his surgery in September 2006. 3. Defendant's Motion for Summary Judgment (Filing No. 28 ) is granted as to (1) Plaintiffs claim for back pay from the earlier of when Tomlinson stopped his job search or the date of his surgery in September 2006, (2) Plaintiff's claim for front pay, and (3) Plaintiff's claim for reinstatement.
