August 6, 2009 Opinion or Order Filing 17 ORDER approving 16 Stipulation. IT IS THEREFORE ORDERED, ADJUDGED AND DECREED as follows: The parties' Stipulation is hereby approved. Three thousand forty-nine dollars and seventy cents of the Defendant property shall be returned to the Cla imant, David Meysembourg, by delivering the same to his attorney of record, Franklin E. Miner. The Marshal shall deliver said amount by making payment to Franklin E. Miner's Trust Account. Pursuant to this Court's Order dated May 26, 2009 7 , the United States has published notice of its intent to dispose of the property in such a manner as the Attorney General may direct. A Declaration of Publication was filed herein on July 31, 2009. No person or entity has filed a Petition, in response to said published notice, setting forth any legal or equitable interest in the subject property. The remaining Defendant property, viz., $27,447.30, is hereby forfeited to the United States. All right, title or interest in or to the D efendant property held by any person or entity is hereby forever barred and foreclosed. The Marshal shall dispose of said $27,447.30 in accordance with law. Upon Mr. Miner's receipt of the $3,049.70, as mentioned above, Mr. Miner shall file a Receipt for said amount. Upon the filing of said Receipt, this Court shall enter a Judgment in this action. Ordered by Magistrate Judge Thomas D. Thalken. (PCV, )
July 16, 2009 Opinion or Order Filing 14 ORDER that upon notice of settlement, the parties shall electronically file a joint stipulation for dismissal on or before August 17, 2009. Absent compliance with this order, this case (including all counterclaims and the like) may be dismissed without further notice in accordance with NECivR 68.1.
