Filing 24 MEMORANDUM AND ORDER - In light of these findings, the court will dismiss Widtfeldt's Complaint for lack of subject matter jurisdiction and failure to state a claim upon which relief may be granted. The court need not reach Defendants' othe r arguments for dismissal. IT IS THEREFORE ORDERED that: 1. The United States' Motion to Strike (filing no. 17 ) is denied. 2. Nebraska's Motion to Dismiss (filing no. 8 ) and the United States' Motion to Dismiss (filing no. 12 ) are granted. 3. Widtfeldt's Complaint is dismissed without prejudice. 4. A separate judgment will be entered in accordance with this Memorandum and Order. Ordered by Judge Richard G. Kopf. (Copy mailed to pro se party)(JAB) |
