Defendants' motion to dismiss the plaintiff's amended complaint, (Filing No. 21 ) is granted. P laintiff's improperly denominated "final motion for summary judgment," (Filing No. 26 ), construed as a motion for an extension of time in which to file a response to the defendants' motion to dismiss, is granted; the response is deemed timely filed on August 28, 2015. Defendants' amended and reasserted motion to dismiss (Filing No. 31 ) is granted as duplicative of Filing No. 21 . Plaintiff's motion for leave to file a second amended complaint (Filing No. 35 ) and supplemental motion to amend (Filing No. 38 ) are denied as futile. Defendants' objection (Filing No. 37 ) to the Plaintiff's motion for leave to file a second amended complaint is sustained. A judgment of dismissal will issue this date.
