Filing 40 TEXT ORDER - This matter is before the court following a telephone conference with the court and counsel for the parties. The plaintiff William Moore was represented by Donna S. Colley, the plaintiff Larson Cement Stone Co. was represented by Gregory W. Plank, and the defendant Besser Company was represented by Cory M. Curtis and Kristin L. Leveille. During the conference it was agreed that by April 15, 2016, the defendant Besser Company shall file a dispositive motion on the basis of the statute of repose and the plaintiff Moore shall pose interrogatories to Besser Company regarding sales of brick-splitting devices. Besser Company has agreed to respond to such interrogatories on or before May 2, 2016. The court will hold a telephone planning conference with counsel on May 16, 2016, at 9:00 a.m. Counsel for the plaintiff Moore shall initiate the telephone conference. During such conference, counsel shall be prepared to discuss mediation and the selection of a mediator. If otherwise engaged in trial, counsel for Larson Cement is excused from such conference.
