Filing 55 MEMORANDUM AND ORDER - The United States' Motion for Summary Judgment (Filing No. 37 ) is granted. The United States is entitled to summary judgment against defendant Estate of Carl Mengedoht for unpaid federal estate tax liability in the amoun t of $2,790,403.66 as of October 1, 2018, plus interest and statutory additions according to law from October 1, 2018, until this judgment is paid. The United States is entitled to foreclose its valid tax liens against the Estate of Carl Mengedo ht in the amount of $2,790,403.66 as of October 1, 2018, plus interest and statutory additions according to law from October 1, 2018, which attach to and encumber Jan Mengedoht's interests in real property in Washington County, Nebraska, de scribed in this Memorandum and Order at 2-3, n. 2. The United States is entitled to collect the liabilities previously described by selling the subject property. The Court orders sale of the subject property under 28 U.S.C. § 2001. Proceeds from that sale shall be paid first to the United States for the costs associated with the sale and next to Washington County Treasurer for any unpaid real property taxes, remaining sales proceeds shall be distributed to the United States to satisfy the Court's judgment. After the federal tax lien has been satisfied, residual proceeds, if any, should be paid to the Trust, the property's present titleholder. Ordered by Senior Judge Joseph F. Bataillon. (LKO) |
