Filing 47 ORDER - The jury trial of this case is set to commence before Laurie Smith Camp, Senior United States District Judge, in Courtroom 2, Roman L. Hruska Federal Courthouse, 111 South 18th Plaza, Omaha, Nebraska, a 9:00 a.m. on October 15, 2019, o r as soon thereafter as the case may be called, for a duration of four (4) trial days. Jury selection will be held at the commencement of trial. The Pretrial Conference is scheduled to be held before the undersigned magistrate judge on October 1, 2019 at 11:00 a.m., and will be conducted by internet/telephonic conferencing. Counsel shall use the conferencing instructions assigned to this case to participate in the conference. The parties' proposed Pretrial Conference Order and Exhibi t List(s) must be emailed to zwart@ned.uscourts.gov, in Word format, by 5:00 p.m. on September 30, 2019. As to the issue of damages, the deadlines for complete expert disclosures1 for all experts expected to testify at trial, (both retained expe rts, (Fed. R. Civ. P. 26(a)(2)(B)), and non-retained experts, (Fed. R. Civ. P. 26(a)(2)(C)), are For the plaintiff(s): June 11, 2019. For the defendant(s): July 11, 2019. Plaintiff(s)' rebuttal: July 25, 2019. The deposition deadline is Septembe r 3, 2019. All requests for changes of deadlines or settings established herein shall be directed to the undersigned magistrate judge, including all requests for changes of trial dates. Such requests will not be considered absent a showing of due diligence in the timely progression of this case and the recent development of circumstances, unanticipated prior to the filing of the motion, which require that additional time be allowed. Plaintiff Fred Roberts's Second Claim for Relief is dismissed, with prejudice; b. Plaintiff Fred Roberts's claim under 49 U.S.C. § 20109(c)(1) for denying, delaying, or interfering with medical treatment is dismissed, with prejudice; and The Motion is otherwise denied. Filing 24 ORDER - The deadline for completing written discovery under Rules 33, 34, and 36 of the Federal Rules of Civil Procedure is September 21, 2018. Motions to compel such discovery must be filed by October 5, 2018.
