August 4, 2020 Opinion or Order Filing 35 ORDER - This matter is before the Court on the parties' Joint Motion for Dismissal Against Defendant, Hugh Abrahamson (Filing #33 ). Pursuant to Federal Rule of Civil Procedure 21, Plaintiffs' claims against Hugh Abrahamson are dismissed with prejudice, each party to bear its own costs and fees. The Clerk of Court is directed to terminate Hugh Abrahamson as a party to this case. Ordered by Judge Brian C. Buescher. (LKO)
August 4, 2020 Filing 34 PROPOSED ORDER FOR UNOPPOSED STIPULATION FOR DISMISSAL by Attorney Hugh I. Abrahamson on behalf of Defendant Hugh Abrahamson.(Abrahamson, Hugh) Modified on 8/4/2020 to reflect proposed order rather than motion (LKO).
August 4, 2020 Filing 33 UNOPPOSED MOTION to Dismiss Party Hugh Abrahamson by Attorney Hugh I. Abrahamson on behalf of Defendant Hugh Abrahamson.(Abrahamson, Hugh)
August 3, 2020 Opinion or Order Filing 32 ORDER - This matter is before the Court on Plaintiffs' and defendant Hugh Abrahamson's Stipulation for Dismissal (Filing #31 ). Plaintiffs and Abrahamson stipulate that Abrahamson should be dismissed as a party to this action. Filing #31 at 1. Federal Rule of Civil Procedure 41(a) governs dismissal of actions by stipulation, but the moving parties do not ask the Court to dismiss this entire action. Rather, they seek dismissal of one party. Federal Rule of Civil Procedure 21 allows the Court to "[o]n motion... at any time, on just terms, add or drop a party." However, the document pending before the Court is a stipulation instead of a motion. Therefore, the Court denies the dismissal Plaintiffs and Abrahamson seek in their present filing and directs them to comply with Rule 21 by filing a joint motion seeking dismissal. Ordered by Judge Brian C. Buescher. (LKO)
