February 23, 2022 Opinion or Order Filing 8 MEMORANDUM AND ORDER - All official-capacity claims are dismissed without prejudice. All claims against Defendants John and Jane Does 1-10 are dismissed without prejudice. Plaintiff shall have 30 days to file an amended complaint in accordance with this Memorandum and Order. In the event Plaintiff files an amended complaint, failure to consolidate all claims into one document may result in abandonment of claims. Plaintiff is warned that an amended complaint will supersede, not supplement, prior pleadings. The court reserves the right to conduct further review of Plaintiff's claims pursuant to 28 U.S.C. 1915(e) and 1915A in the event Plaintiff files an amended complaint. If Plaintiff does not file an amended complaint within 30 days, the court will direct the Clerk of the Court to issue summonses for Defendants Cotant, Dedinsky, White, Rivas, Wolf, and Bretthauer, in their individual capacities only, and to forward the summonses and copies of Plaintiff's Complaint (Filing #1 ) to the United States Marshal for service. The Clerk of the Court is directed to set a pro se case management deadline using the following text: March 25, 2022amended complaint due. The court must be kept informed of Plaintiff's current address at all times while this case is pending. January 26, 2022 Opinion or Order Filing 7 MEMORANDUM AND ORDER - Plaintiff's Motion for Leave to Proceed IFP (Filing #2 ) is granted. Plaintiff must pay an initial partial filing fee of $17.20 within 30 days, unless the court extends the time in which he has to pay in response to a written motion. After payment of the initial partial filing fee, Plaintiff's institution must collect the additional monthly payments in the manner set forth in 28 U.S.C. 1915(b)(2), quoted above, and forward those payments to the court. The clerk's office is directed to send a copy of this order to the appropriate official at Plaintiff's institution. The clerk's office is directed to set a pro se case management deadline in this case using the following text: February 25, 2022: initial partial filing fee payment due.
