MEMORANDUM AND ORDER - IT IS ORDERED: Plaintiff shall have until March 4, 2026, to file an amended complaint as to the First Amendment retaliation claim. Failure to file an amended complaint within the time specified by the Court will result in the Court dismissing this case without further notice to Plaintiff. The Court reserves the right to conduct further review of Plaintiff's claims pursuant to 28 U.S.C. 1915(e)(2) and 28 U.S.C. 1915A(b) in the event he files an amended complaint. MEMORANDUM AND ORDER - IT IS THEREFORE ORDERED THAT: Plaintiff's Motion to Amend, Filing No. 9, is granted. Plaintiff now has through and until February 5, 2026, to file an amended complaint in compliance with this order. If Plaintiff fails to file an amended complaint or otherwise respond or seek an extension to do so prior to the expiration of the February 5, 2026, deadline, the Court shall perform an initial review of the claims set forth in Plaintiff's Initial Complaint, Filing No. 1, to determine whether summary dismissal is appropriate under 28 U.S.C. 1915(e)(2). The Clerk's Office is directed to set a pro se case management deadline in this case using the following text: February 5, 2026: Check for amended complaint. The Clerk of the Court is directed to send Plaintiff the Form Pro Se 14 ("Complaint for Violation of Civil Rights (Prisoner)"). Ordered by Senior Judge John M. Gerrard. MEMORANDUM AND ORDER - IT IS THEREFORE ORDERED that: Plaintiff's Motion, Filing No. 11, is granted. Plaintiff shall have through and until January 29, 2026, to submit his $1.38 initial partial filing fee in compliance with the Court's November 26, 2025, show cause order, Filing No. 10. By January 29, 2026, Plaintiff's institution shall deduct the initial partial filing fee of $1.38 from Plaintiff's institutional account if such funds are available and remit payment to the Clerk of Court. The Clerk's office is directed to send a copy of this Memorandum and Order to the appropriate official at Plaintiff's institution. The Clerk of Court shall terminate the December 29, 2025, check for response to show cause order deadline, and shall set the following pro se case management deadline of January 29, 2026: check for payment or response to show cause order. Plaintiff is reminded that it is his responsibility to ensure the initial partial filing fee of $1.38 is paid. To the extent Plaintiff seeks additional time to comply with this order he must file a written motion with this Court explaining why additional time is needed before the deadline for compliance has passed. MEMORANDUM AND ORDER - IT IS THEREFORE ORDERED that: Plaintiff's Motion for Leave to Proceed IFP, Filing No. #2 , is granted. Plaintiff must pay an initial partial filing fee of $1.38 within 30 days unless the Court extends the time in which he has to pay in response to a written motion. After payment of the initial partial filing fee, Plaintiff's institution must collect the additional monthly payments in the manner set forth in 28 U.S.C. 1915(b)(2), quoted above, and forward those payments to the Court. The Clerk's office is directed to send a copy of this order to the appropriate official at Plaintiff's institution.
