| Filing 8 MINUTE ORDER IN CHAMBERS of the Honorable Magistrate Judge Craig S. Denney on 4/23/2024. CASE STATUS INQUIRIES - CASE IN SCREENING - Before the court is your letter requesting status. As the court clerk advised you in the Advisory Letter confirming receipt of your initial filings, due to the large number of inmate civil rights actions pending before the court, the court is unable to respond in writing to individual inquiries regarding the status of your case. Plaintiff is advised, however, that your case is in line for screening. Plaintiff must await the court's initial review of cases filed ahead of yours which are being addressed at present. As long as you keep the court apprised of your current address, you will receive all court decisions which might affect the status of your case. MOTIONS - A document requesting a court order must be styled as a motion, not a letter. See Local Rule IA 10-2. Letters to a judge will be disregarded. See Federal Rules of Civil Procedure 7. OTHER - Electronic filing of prisoner filings in civil rights cases at Ely State Prison is now mandatory under General Order 2012-01. (Copies have been distributed pursuant to the NEF - DLS) |

ORDERED that Plaintiff's first application to proceed in forma pauperis (ECF No. #1 ) is denied without prejudice as incomplete. It is further ordered that Plaintiff's second application to proceed in forma pauperis (ECF No. #4 ) is denied without prejudice as incomplete. It is further ordered that Court's March 8, 2024, order (ECF No. #3 ) setting a deadline for Plaintiff to either pay the full $405 filing fee or file with the Court a copy of the inmate's trust fund account statement for the previous six-month period (ECF No. #3 ) is vacated. It is further ordered that Plaintiff has until May 14, 2024, to either pay the full $405 filing fee or file with the Court a new fully complete application as detailed herein. The Clerk of the Court is directed to resend Plaintiff Marque Gardeley the approved form application to proceed in forma pauperis for an inmate and instructions for the same (form attached hereto for distribution to P via ESP law library), and to retain the complaint (ECF No. #1 -1) but not file it at this time.
