May 10, 2022 Opinion or Order Filing 5 TEXT ORDER: It has come to the Court's attention that while Petitioner has made efforts to serve Respondents, service according to the Federal Rules of Civil Procedure has not yet been effectuated. While summonses are not necessary, Petitioner must serve its motion to compel on Respondents according to the process outlined in Federal Rule of Civil Procedure 4(i)(1)(A) and (B). Petitioner is directed to inform the Court in writing to tjb_orders@njd.uscourts.gov once service of its motion to compel has been so effectuated. In the interim, the telephone conference set to take place on 5/12/2022 is adjourned, and shall be rescheduled after service of the motion is complete. Further, no later than 5/13/2022, Petitioner is directed to advise in writing to tjb_orders@njd.uscourts.gov whether there is a legal provision prohibiting Petitioner from agreeing to the entry of a protective order regarding the information sought in its subpoena, or case law supporting Petitioner's decision not to consider or agree to the entry of same. To the extent there is not, the Court directs Petitioner to confer with Respondents' in-house counsel, Ms. Levine, in an effort to reach an agreement on an appropriate protective order. While Ms. Levine does not represent Respondents for purposes of Petitioner's motion to compel, she appears willing to engage in discussions regarding the protective order on Respondents' behalf.
