| MINUTE ENTRY and ORDER for Pre-Motion Conference held before Judge Kiyo A. Matsumoto on October 7, 2019. Appearance for Plaintiff: Jason M. Drangel, Esq. Appearance for Defendants: Richard Henry Dolan, Esq.; Philip A. Kantor, Esq. The parties discussed Defendants' proposed motion for summary judgment. The Court urged the parties to consider settlement negotiations. While Plaintiff indicated it is interested in proceeding to settlement talks, counsel for Defendants indicated that their clients may not agree to proceed to settlement talks at this time. The Court therefore ordered the parties to file a joint status letter by Friday, October 11, 2019, indicating whether the parties will agree to proceed to a settlement conference before Magistrate Judge Ramon E. Reyes. If the parties agree to do so, they shall jointly contact Judge Reyes' chambers to schedule a settlement conference.Defendants also requested that the Court extend their time to answer the complaint. The Court hereby holds Defendants' time to answer the complaint in abeyance, and in the joint status letter to be filed on Friday, October 11, 2019, Defendants shall propose a date by which they will file their answer.Finally, Plaintiff indicated that if Defendants elect to proceed with their motion for summary judgment, Plaintiff will seek discovery. Pursuant to Rule 56(d) of the Federal Rules of Civil Procedure, "[i]f a nonmovant shows by affidavit or declaration that, for specified reasons, it cannot present facts essential to justify its opposition, the court may... allow time... to take discovery." The Court informed Defendants that it would be inclined to grant such a request from Plaintiff at this juncture and that this discovery would proceed before Judge Reyes.
