No. 300 ) is DENIED with respect to Plaintiff's fabrication of evidence claim (Fi rst and Second Causes of Action) against Defendant Cerminaro and his defamation claim (Eleventh Cause of Action) against Defendants Cerminaro and City of Utica, and GRANTED in all other respects. The motions for summary judgment by Defendant Dough erty (Dkt. No. 307 ) and the County Defendants (Dkt. No. 308 ) are GRANTED in their entirety and the following claims are DISMISSED with prejudice: Plaintiff's Brady claim (First Cause of Action); Plaintiffs fabrication of evidence claim (Fir st Cause of Action) against Defendants Dougherty and Paladino; Plaintiff's fabrication of evidence claim (Second Cause of Action) against Defendants Dougherty and Paladino; Plaintiff's malicious prosecution claims (Third and Fourth Cause of Action); Plaintiff's failure to intervene claim (Fifth Cause of Action); Plaintiff's Monell claim (Sixth Cause of Action); and Plaintiff's defamation claims (Seventh and Eighth Causes of Action) against Defendants McNamara and the County of Oneida.
