DECISION AND ORDER: ORDERED that #2 Motion for Leave to Proceed in forma pauperis is granted. ORDERED that plaintiff's complaint (Dkt. No. 1) is ACCEPTED for filing only to the extent that it asserts First Amendment free exercise claims against defendants Saxton and Prichard based on allegations that defendant Saxton disposed of plaintiff's Kosher meal and defendant Prichard deprived plaintiff of Matza crackers on the Sabbath. ORDERED that, except as to the foregoing, the claims asserted in plaintiff's complaint are otherwise DISMISSED without prejudice for failure to state a claim upon which relief may be granted pursuant to 28 U.S.C. 1915(e)(2)(B)(ii) and 28 U.S.C. 1915A(b)(1). ORDERED that the Clerk of the Court shall TERMINATE from the docket defendants Collins, Mulcahy, Terise, Tucker, Baily, Disorbo, John Doe 1, John Doe 2, and John Doe 3. ORDERED that the Clerk shall issue a summons and forward it, along with a copy of the complaint, to the United States Marshal for service upon defendants Saxton and Prichard. ORDERED that plaintiff's motion for the appointment of counsel (Dkt. No. 1) is DENIED without prejudice. Signed by Chief Judge Glenn T.
