OPINION AND ORDER granting in part and denying in part 7 Naphcare Defendants' Motion to Dismiss, in that the Court DENIES IN PART the motion, while consistent with this decision GRANTS IN PART such motion as to Plaintiff's claims pursuant to OAC 5120:1-8-19, which currently does not exist under Ohio law, and Ohio Revised Code 5120.01, which sets forth the duties of the non-Defendant director of the Ohio Department of Rehabilitation and Corrections; granting 14 County Defendants Robert Davis and D.
