ORDER RE: docs. 48 & 50: The Citys motion for summary judgment is granted with respect to all Plaintiffs facial and as-applied procedural due process, substantive due process, and retroactivity claims, and on the Rechel Plaintiffs federal takings c laims. Plaintiffs claims for civil conspiracy, unjust enrichment and breach of fiduciary duty are dismissed with prejudice. The Citys motion for summary judgment is granted in its entirety with respect to the Kahles Plaintiffs, and their complaint is dismissed with prejudice. The Court declines to exercise supplemental jurisdiction over the remaining state law claims alleged by Rechel Plaintiffs. Their claims for breach of contract, mandamus, declaratory judgment, and a takings claim under Article I, Section 19 of the Ohio constitution, are remanded to the Hamilton County, Ohio Court of Common Pleas.
