Holmes' claims set forth in Counts 4, 8 and 9 of her amended complaint are dismissed with prejudice. All of Holmes' claims against the individual Defen dants Ted Nussman, Eric Ringhauser, Teresa Gilligan, Lisa Berning, and Troye Shirley, are dismissed with prejudice. The claims for racial and disability discrimination and FMLA retaliation, Counts 1, 2, 3, 5, 6 and 7, are dismissed without prejudice and with leave to amend those claims.
