Ancestrys motion to dismiss is GRANTED IN PART AND DENIED IN PART. Ancestrys motion to dismiss is GRANTED as to Count V of DDCs counterclaim and the por tions of Count VI and VIII that are based on Ancestrys litigation activities such as filing the lawsuit and complaining to Groupon about alleged infringement by DDC. Those claims are DISMISSED WITH PREJUDICE. Ancestrys motion to dismiss is DENIED as to that part of Count VI that covers other modes of unfair competition, and that part of Count VIII that is based on Ancestrys alleged disparaging comments about DDC.
