IT IS RECOMMENDED THAT: (1) This case be DISMISSED WITH PREJUDICE for failure to state any claim under 28 U.S.C. 1915(e)(2); (2) Plaintiff should be warned that if he files any additional lawsuits that are deemed to be frivolous or duplicative, his litigation practice may be deemed to be vexatious, with the possibility that pre-filing restrictions will be imposed prior to permitting him to file new lawsuits; (3) The Court should certify pursuant to 28 U.S.C. 1915(a) that an appeal of any Order adopting this Report and Recommendation would not be taken in good faith and therefore deny Plaintiff leave to appeal in forma pauperis.
