REPORT AND RECOMMENDATIONS re #1 Plaintiff's Motion for Leave to Proceed in forma pauperis, #2 Plaintiff's Motion for Temporary Restraining Order. IT IS RECOMMENDED THAT: (1) Defendant's removal petition should be DENIED for lack of subject matter jurisdiction, and this improperly removed case should be REMANDED to the Middletown Municipal Court; (2) Defendant's motion for leave to proceed in forma pauperis #1 should be DENIED; (3) Defendant's motion for an Ex parte Temporary Restraining Order #2 also should be DENIED; (4) The Court should certify pursuant to 28 U.S.C. 1915(a) that an appeal of this Order would not be taken in good faith and therefore deny Defendant leave to appeal in forma pauperis.
