Notation Order: This civil action is before the Court upon sua sponte review of the notice of removal pursuant to federal question and supplemental jurisdiction (Doc. #1 ), and the parties' stipulated notice of dismissal of the only federal claim (Doc. #9 ). Based on the parties stipulated notice of dismissal, Defendant Great Lakes Services, LLC's motion to dismiss count VIII (Doc. #6 ) is DENIED as moot. Moreover, the Court finds that no federal claim exists and remand may be appropriate. 28 U.S.C. 1367(c). Accordingly, Great Lakes is granted leave to file a motion in support of jurisdiction within fourteen (14) days of this Order, including whether: (i) there is diversity of citizenship among the Plaintiffs and partners/members of Great Lakes; and (ii) the amount in controversy plausibly exceeds the jurisdictional threshold. Responsive briefing, as necessary, may then follow per local rules. Alternatively, the parties may indicate consent to remand. IT IS SO ORDERED. Signed by Judge Timothy S. Black on 6/3/2021. (rrs)
