January 31, 2022 Opinion or Order Minute Entry and Notation Order: This civil case came before the Court for a status/discovery conference on 01/31/2022 at 2:30 p.m. Matthew Wiles appeared on behalf of Plaintiff; Pamela Abbate Dattilo and Lukas Boehning appeared on behalf of Defendant Traffic Tech, Inc.; Robin Miller appeared on behalf of Defendant Nickolas Dugger. For reasons stated, the Court DENIED that portion of Plaintiff's motion (Doc. #22 ) to stay discovery pending TQL's motion to compel arbitration. (Doc. #22 ). The Court has ample discretion to stay or not stay discovery while a motion is pending. See e.g., Ohio Bell Tel. Co. v. Glob. NAPs Ohio, Inc., No. 2:06-CV-0549, 2008 WL 641252, at *1 (S.D. Ohio Mar. 4, 2008). Using that discretion, the Court has determined a stay of discovery is not appropriate at this time. In general, the Court discerns no exceptional circumstances justifying a stay of discovery. Plaintiff only raised to the Court the arbitrability of the "unclean hands" issuethe issue for which it seeks to stay discoveryafter it received a partially-adverse ruling on the question on its motion for a TRO. (Doc. #21 ). Moreover, even if the Court granted Plaintiff's motion to compel arbitration, the parties would continue to litigate in this forum. On the issue of discovery, Defendant Traffic Tech has agreed to produce sales data for Dugger's clients at Traffic Tech before and during Dugger's employment at Traffic Tech. Accordingly, Traffic Tech SHALL produce such information subject to the schedule below. On the motion to compel arbitration (Doc. #22 ), Defendants SHALL file opposition by no later than 02/07/2022, and Plaintiff SHALL file a reply by no later than 02/10/2022. Additionally, the parties discussed and agreed to a schedule for remaining discovery and briefing. Accordingly, the parties SHALL: i) Produce outstanding documents and responses to interrogatories consistent with this Court's discovery Order (Doc. #21 ) by no later than 02/10/2022; ii) Complete depositions by 02/28/2022; and iii) File briefs on Plaintiff's motion for a preliminary injunction by 3/14/2022.
