Filing 8 ORDER - It is therefore ORDERED that the February 22, 2022 Opinion and Order (Doc. #7 ) is VACATED to the extent that it ordered service by the United States Marshal. Plaintiff is ORDERED to serve a summons and copy of the complaint on Defendants William Cool, Denny, Goodman, Doctor Conley, and on Jon Does 1-6, if and when Plaintiff discovers the identity of the unnamed Defendants through discovery. Failure to comply with the terms of this Order shall result in a Report and Recommendation to the District Court that Plaintiffs claims against Defendants be dismissed for lack of service. Filing 7 ***VACATED per #8 *** OPINION AND ORDER - It was further recommended that Plaintiff be ordered to pay the full filing fee within thirty days of any Order adopting the Report and Recommendation. (Doc. #3 ). Plaintiff has since paid the filing fee. (Doc. #6 ). In light of Plaintiffs payment of the full filing fee in this action, the January 21, 2022 Report and Recommendation (Doc. [3)] is VACATED and Plaintiffs motion for leave to proceed in forma pauperis (Doc. #1 ) is DENIED as moot.It is therefore ORDERED that the United States Marshal shall serve a copy of the complaint, summons, and this Order upon Defendants William Cool, Denny, Goodman, and Doctor Conley as directed by Plaintiff. All costs of service shall be advanced by the United States. Before service may be issued upon any remaining John Doe Defendants, Plaintiff must file a motion to issue service setting forth the identities of the unidentified Defendants. Plaintiff is therefore ORDERED to file a motion to issue service, including United States Marshal and summons forms, if and when Plaintiff discovers the identity of the unnamed Defendants through discovery. Plaintiff is advised that no service will be issued on the unnamed Defendants unless Plaintiff complies with this Order. It is further ORDERED that Plaintiff shall serve upon Defendants or, if appearance has been entered by counsel, upon Defendants attorney(s), a copy of every further pleading or other document submitted for consideration by the Court. Plaintiff shall include with the original paper to be filed with the clerk of court a certificate stating the date a true and correct copy of any document was mailed to Defendants or counsel. Any paper received by a district judge or magistrate judge which has not been filed with the clerk or which fails to include a certificate of service will be disregarded by the Court. It is further ORDERED that Plaintiff shall inform the Court promptly of any changes in his address which may occur during the pendency of this lawsuit. IT IS SO ORDERED.
